Sonia Gandhi
ਸੋਨੀਆ ਗਾਂਧੀ
Italian-born Congress leader, party president 1998 to 2017. Sikhs for Justice sued her in a US court over 1984; dismissed in 2014, upheld on appeal in 2015. Rajya Sabha member since 2024.
Sonia Gandhi is the Italian-born leader who headed the Indian National Congress for nineteen years. She is the daughter-in-law of Indira Gandhi. For the Panth she matters because she led the Congress, the party Sikh leaders keep asking to answer for 1984, and because of the US lawsuit that Sikhs for Justice brought against her. She is a living public figure; the facts below are sourced and the judgments are attributed.
Key moments
- 1998 to 2017: she took over the Congress in 1998 and led it until 2017, the longest term of any Congress president (Gulf News, Khaleej Times). She returned as interim president in 2019.
- 2004: after the Congress victory she declined to become Prime Minister and named Manmohan Singh (NPR).
- August 2005: after the Prime Minister's apology in the Rajya Sabha for the November 1984 killings of Sikhs, the Tribune reported that the Akali leader Parkash Singh Badal said she should have apologised herself, and Harinder Singh Delhi, a member of the SGPC (the Tribune prints his name so), asked her to apologise for the part played by her party. A Congress leader, Sukhpal Singh Khaira, answered that Badal was using petty tactics to keep the issue alive.
- 2013 to 2015: Sikhs for Justice and other plaintiffs sued her in a US federal court under the Alien Tort Statute and the Torture Victim Protection Act, accusing her of shielding Congress leaders involved in the 1984 violence. She did not contest the court's jurisdiction over her person. In 2014 Judge Brian Cogan dismissed the case: the group lacked standing, the ten-year limit under the Torture Victim Protection Act had long passed, and she could not be held personally liable because she became party president only in 1998. In August 2015 the US Court of Appeals for the Second Circuit dismissed the appeal for lack of subject-matter jurisdiction and failure to state a claim, citing the Supreme Court's Kiobel decision.
- 20 February 2024: she was elected unopposed to the Rajya Sabha from Rajasthan, as Manmohan Singh's term from the state was ending on 3 April.
The courts dismissed the case on legal grounds (standing, the time limit, jurisdiction and failure to state a claim) and no trial on the allegations was held. Sikh leaders have separately asked for an apology from her family and party, as the 2005 reactions show.
