Is the Khalistan Referendum a legitimate exercise?
Non-binding by its own terms; only the organisers’ turnout counts; none held in India by 2023. Delhi calls it farcical; host states allow it but do not recognise it; Sikh bodies differ on method.
The claim: The vote is not a real referendum and has no standing. Foreign ministry spokesman Arindam Bagchi called the Brampton vote of September 2022 a “farcical exercise held by extremists and radical elements” (The Tribune). After the Ottawa vote of November 2025, High Commissioner Dinesh Patnaik told CBC “Referendums have a certain process”, asked how Canadians would feel if another country did the same with Quebec, and said peaceful protest is “part of a political process” (The Tribune, ANI). A UAPA tribunal upheld a five-year ban on the organiser, Sikhs for Justice (SFJ), in January 2025 (The Tribune). The scholar Shinder Purewal compared the vote to Quebec holding a vote in Russia (The Globe and Mail, 16 July 2023), and the former CSIS executive Dan Stanton called the movement fringe (The Globe and Mail, 7 July 2023).
The sourced facts:
- It is non-binding by its own terms. SFJ’s site calls it “an unofficial referendum where the outcome is not legally binding” and says outside Punjab “only SIKHS are eligible to vote”. Global News noted on 10 September 2023 that votes were held in many countries “but not India”.
- Every turnout figure is the organisers’ own claim; no independent count has been published. London, 31 October 2021: 30,000, counted, Gurpatwant Singh Pannun said, by experts hired for the voting (Geo). Brampton, 18 September 2022 (The Tribune says 19): “comfortably over 110,000” per organisers and local observers (Geo), but videos showed a crowd of about 1,000 (The Tribune). Melbourne, January 2023, “over 50,000” and Sydney, June 2023, “over 31,000”, both unattributed in Geo, which relied on Pannun and Bakhshish Singh Sandhu. Surrey, 10 September 2023: “tens of thousands”, with organisers estimating 100,000 or more, which Global News did not verify.
- Host governments allow it without recognising it. Canada said in 2018 it “would not recognize such a referendum” (Global News), and in December 2022 that people in Canada “are free to assemble and express their views, so long as they do so peacefully and lawfully” (The Globe and Mail).
- India’s 1979 declaration on the ICCPR says self-determination applies “only to the peoples under foreign domination” (India’s UN mission). The Supreme Court of Canada held in 1998 that Quebec cannot secede unilaterally and that only a clear majority on a clear question triggers a duty to negotiate (Centre for Constitutional Studies).
- SFJ’s flyers for its July 2023 protests carried the words “Kill India”; Pannun said the phrase means Punjab becoming its own country, not violence (The Globe and Mail).
The Panthic answer: There is no single Panthic verdict on this vehicle, and we found no statement on the SFJ vote itself from Sri Akal Takht Sahib or the SGPC. Pannun says the method is “the ballot instead of the bullet” (The Globe and Mail) and that Sikhs qualify for self-determination because Punjab was a state until the British annexed it in 1849 (Global News, 2018). SFJ director Jatinder Grewal said the Surrey turnout shows Khalistan “is not an issue for a fringe group of people” (Global News).
The Akal Takht has spoken about the goal, as distinct from the vote. On 6 June 2020 Jathedar Giani Harpreet Singh said “we will accept it” if the government offers Khalistan, and SGPC president Gobind Singh Longowal said no Sikh could refuse such an offer (The Tribune). About a week later the Jathedar said Sikhs cannot be defined by Khalistan alone and that the Constitution gives every Sikh “the right to carry out this struggle peacefully” (IANS, South Asia Monitor).
Other Panthic voices back the aim but doubt SFJ’s route. In 2018 Dal Khalsa and Simranjit Singh Mann’s Shiromani Akali Dal (Amritsar) called Referendum 2020 “farfetched” and “unworkable” (The Week). Mann said in a TV interview that a private party cannot hold a referendum: only a country, or a UN Security Council plebiscite as on Kashmir in 1948, can (Sikh Siyasat News). Dal Khalsa’s own demand is a “plebiscite under the UN and not elections under Indian dispensation” (April 2024, Sikh Siyasat News).
